Clearing

The world of clearing kept moving after the first edition went to press.

Rule proposals are published, market structure shifts, and clearing models nobody anticipated appear. Each time, the institutions and practices set out in the book need to be checked against the new facts.

This page tracks what has moved since publication, drawn from primary sources in Japan and abroad — not just the latest regulatory developments, but what they mean in practice for clearing participants, clearing brokers, customers, and the market as a whole.

Each piece is placed against the relevant chapter of the first edition and carries its sources and first-publication date. Assessments may change as the rules and the debate evolve.

Institutionalizing Direct Clearing: What Changes — and What Remains — Once Credit Extension Is Removed
The CFTC's request for comment and industry letters show the regulatory line is drawn not by asset type but by whether the customer has already prefunded the loss. That line, however, leaves further questions unanswered.

Who Bears the Legal Obligations When Clearing Bypasses the FCM? The Regulatory Gaps Left by Retail Direct Clearing
Identity verification and anti-money-laundering obligations attach to the direct customer relationship. Once the FCM is removed, who carries them? Pure direct clearing and the affiliated-FCM model have to be separated first — the CFTC's RFC and the FIA/ISDA comment letters treat them differently.

Can Auto-Liquidation Replace the FCM? The Limits of Leveraged Direct Clearing
Direct clearing is not a retail-only structure. When a fully-collateralized, prefunded model extends to leverage, what can auto-liquidation replace, and what remains outside it? The dividing line is when the maximum loss is funded, not who the participant is.

Is Japan's Retail FX Market a Precedent for Direct Clearing? Where Loss-Cut Operations Converge — and Loss Allocation Diverges
Japan's OTC retail FX market is not an unfinished system lacking a CCP — it is a complete bilateral model where the dealer itself is the customer's counterparty. The two models share a loss-cut technique but differ in legal counterparty and in how losses are allocated.
